Terms of Service

Sellio AI is an AI-powered mobile app that helps online sellers turn raw product photos into publish-ready marketplace visuals — including listing-pack image sets, lifestyle scenes, hero shots, macro spotlights, 360° angle grids, mannequin-to-flat-lay transforms, virtual try-ons, and other commerce-focused image generations. The Service is offered on a subscription and/or credit-based ("Diamonds") model.

• Age Requirement: You must be at least 18 years old, or have reached the legal age of majority in your jurisdiction, to use the Platform and enter into a binding contract.
• Account: Creating an account is required for AI generation, purchases, and history features. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• No Free Trial: Sellio AI does not offer a free trial period. Access to AI generation and premium features requires the purchase of Diamonds or an active subscription as specified inside the App.

• Ownership:You retain all rights, title, and interest in the photos, prompts, and other content you upload to the Platform ("User Content").
• License to Us: By uploading User Content, you grant Sellio AI a worldwide, royalty-free, non-exclusive license to host, process, transmit, modify, and use that content solely as needed to operate, provide, secure, and improve the Service for you.
• Prohibited Content: You may not upload, generate, or transmit content that is illegal, defamatory, sexually explicit, pornographic, nude, NSFW, depicts minors in sexual or suggestive contexts (CSAM), constitutes non-consensual intimate imagery, infringes intellectual property or privacy rights of others, or is otherwise harmful, deceptive, or in violation of applicable law.

• Platform Ownership: All rights, title, and interest in the Platform — including AI models, software, designs, brand assets, and underlying technology — belong to Sellio AI and its licensors.
• Licensed Outputs: Sellio AI grants you a non-exclusive, worldwide, perpetual license to use the images and other outputs you generate through the Service for your own legitimate e-commerce, marketing, and business needs, subject to your compliance with these Terms and the Acceptable Use Policy below.

• Payment Models: The Service offers (a) recurring subscriptions (e.g., monthly, weekly, or annual plans, each with periodic Diamond grants) and (b) one-time Diamond packs that do not expire. All payments are processed through Apple In-App Purchase or Google Play Billing (managed via RevenueCat). Sellio AI does not process payments directly and does not see your card details.
• Diamonds: Diamonds are the in-app credit unit consumed when you run a generation. Subscription Diamonds are granted on each billing cycle and expire at the end of that cycle. One-time purchased Diamonds do not expire. Failed generations are automatically refunded as Diamonds to your balance.
• Refunds & Cancellation: Refund requests for App Store / Google Play purchases must be submitted through Apple or Google directly, per their respective refund policies. For account- or generation-related disputes, contact us at aiandthehuman@gmail.com. Subscriptions may be cancelled at any time through the Apple App Store or Google Play subscription settings and remain active until the end of the current billing period. Where required by applicable law (e.g., EU consumer protection), you retain your statutory withdrawal rights.
• Price Changes: Sellio AI may modify prices, plan structures, and Diamond pack contents from time to time, with reasonable notice through the App. Material changes will not affect already-purchased one-time Diamond packs.

You agree not to use, and not to allow any third party to use, the Platform to:

• Generate, create, request, or attempt to produce NSFW, sexually explicit, pornographic, nude, partially nude, or otherwise adult sexual content of any kind.
• Generate content that sexualizes minors, constitutes CSAM, or depicts minors in any inappropriate context.
• Create non-consensual intimate imagery, sexual deepfakes, or harassing content targeting any identifiable person.
• Produce harmful, deceptive, hateful, violent, terrorist, or otherwise malicious content.
• Generate content that infringes a third party's intellectual property, publicity, or privacy rights — including counterfeit listings, fraudulent product imagery, or unauthorized use of trademarks and brand logos.
• Bypass, disable, or interfere with any safety, moderation, rate-limit, or security feature of the Platform.
• Reverse engineer, decompile, scrape, or attempt to extract source code, model weights, or training data from the Platform.
• Use automated systems, bots, or scripts to access the Platform other than through officially provided APIs and within their documented limits.

Content Moderation & Enforcement: All inputs submitted to and outputs produced by the Service are subject to automated content moderation, including third-party moderation services provided by our AI infrastructure partners. Violations of this Acceptable Use Policy may result in immediate suspension or termination of your account, forfeiture of unused Diamonds, and, where applicable, referral to law enforcement.

• By You: You may stop using the Service and request account deletion at any time as described in our Privacy Policy.
• By Sellio AI: We may suspend or terminate your access immediately, with or without notice, if you violate these Terms, abuse the Service, or create a security or legal risk to Sellio AI or other users.
• Effect of Termination: Upon termination your access to the App ceases; stored User Content and unused Diamonds may be deleted in accordance with our Privacy Policy and applicable law.

• "As-Is" Basis:The Service and the images and other outputs generated through it are provided "as-is" and "as-available". AI generation can occasionally produce inaccurate, low-quality, biased, or unexpected results. You are solely responsible for reviewing, fact-checking, and confirming the legal compliance of any generated output before publishing it on a marketplace, website, or advertising platform.
• No Warranty: To the maximum extent permitted by law, Sellio AI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
• Liability Cap:To the maximum extent permitted by applicable law, Sellio AI's total aggregate liability arising out of or related to the Service is capped at the greater of (a) the total amounts you paid to Sellio AI in the six (6) months preceding the event giving rise to the claim, or (b) USD 50.
• Exclusions: Sellio AI shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless Sellio AI and its operators from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any rights of a third party.

Sellio AI may update these Terms from time to time. When we make material changes we will notify you through the App, by email, or by updating the "Last Updated" date at the top of this document. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by applicable consumer-protection and contract law in your country of residence. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at aiandthehuman@gmail.com. Mandatory consumer-protection rights in your jurisdiction are not affected by these Terms.

• Entire Agreement: These Terms, together with the Privacy Policy and any plan-specific terms presented at purchase, constitute the entire agreement between you and Sellio AI regarding the Service.
• Severability: If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
• No Waiver:Sellio AI's failure to enforce any right or provision is not a waiver of that right.
• Assignment: You may not assign these Terms without our prior written consent. Sellio AI may assign these Terms in connection with a merger, acquisition, or sale of assets.
